1. About these terms
Humble Trail at humbletrail.com.au is operated by The Ordinary Trade Pty Ltd, 179 Maroondah Hwy, Ringwood VIC 3134, Australia (we, us or our).
These terms explain the permitted use of our website, content and interactive features. Where a feature presents these terms for your agreement, read them before accepting and using that feature. If you do not agree to terms presented for a feature, do not use that feature.
Our Privacy Policy explains personal-information handling. Acceptance of these terms does not constitute consent to optional advertising or tracking. Separate terms may apply to a specifically identified service; we will present those terms before you choose to use it.
2. Our content
We publish travel, lifestyle and other editorial information. Articles may include opinion, rankings, experiences, estimates and information from third-party sources. Preferences differ, and a recommendation or ranking is not a guarantee of a particular experience or outcome.
We aim to provide useful, accurate information and correct material errors brought to our attention. Details such as prices, opening hours, facilities, entry requirements, routes and local conditions can change. Check important details with the relevant operator or official source before booking, travelling or relying on them.
Content is general information. Where an article discusses health, legal, financial, safety or other specialist topics, it is not tailored professional advice for your circumstances. Seek appropriately qualified advice when needed. Nothing here excuses misleading representations or removes rights you have under applicable law.
3. Travel and activities
You are responsible for assessing whether a destination or activity suits your abilities, circumstances and equipment. Follow applicable laws, land-access restrictions, official warnings and instructions from relevant authorities and operators. An article does not authorise entry onto private or closed land.
Conditions may differ from descriptions or photographs. Before an outdoor activity, check current conditions and plan appropriately. In an emergency, contact the appropriate emergency service rather than relying on the website.
4. Using our content
Copyright and other rights in our articles, photographs, graphics and website belong to us or the relevant owners/licensors. Unless another licence is stated, you may access our content for personal use and share links to our publicly available pages.
Permission to read an article does not grant permission to republish it or reuse its photographs. Contact us for permission for uses requiring authorisation. This restriction does not prevent quotations, fair dealing, fair use or other uses permitted by applicable law.
You must not remove ownership notices, falsely imply our endorsement, or commercially reproduce substantial content without permission or another lawful basis.
5. Comments and other submissions
If you submit a comment, image or other material, you must have the rights and permissions reasonably needed for its publication. Use your own identity or a non-misleading display name. Do not submit unlawful material, threats, harassment, defamatory allegations, spam, impersonation, malware, confidential information or another person’s private information without a lawful basis.
Keep comments relevant and distinguish opinion from claims of fact. Do not publish sensitive information you would not want publicly accessible. A submission may be visible to other readers and indexed by search engines.
You retain ownership of your submission. You give us a non-exclusive, worldwide, royalty-free licence to store, reproduce, display and make reasonable formatting or moderation edits to it for operating Humble Trail and displaying the discussion in which you submitted it. We may allow service providers to perform those functions for us. This licence does not authorise unrelated advertising use of your name, likeness or submission without any further permission required by law.
You may contact us to request removal. Once removed, we stop displaying the submission, although limited copies may remain in backups or records for justified operational or legal purposes. Copies already made by others may be outside our control. Personal-information requests are also addressed under our Privacy Policy and applicable law.
6. Moderation and access restrictions
We may review, decline, edit or remove submissions that breach these terms, create a legal or safety concern, disclose private information, or materially disrupt a discussion. Publication does not mean we endorse a submission or have independently verified it.
We may restrict an interactive feature to address serious or repeated misuse, fraud, security threats or legal obligations. Where reasonable and lawful, we will explain the reason and provide a way to ask us to review the decision. Urgent protective action may be taken first. Restrictions do not remove existing statutory rights or privacy-request access.
7. Acceptable website use
Do not interfere with website security or availability, attempt unauthorised access, distribute malicious software, bypass access controls, overload the service, or collect readers’ personal information without a lawful basis. Automated access must respect applicable law and must not materially impair the website or circumvent technical restrictions. Contact us about licensing or high-volume commercial access.
These terms do not prohibit lawful research, statutory rights or activities that cannot legally be restricted by contract.
8. Advertising, affiliates and third-party services
The website contains advertising and may contain affiliate links or sponsored content. Where applicable, we identify commercial relationships in the relevant content. We may receive a commission when a reader follows an affiliate link and completes a qualifying action.
An advertisement is not necessarily an editorial endorsement. External websites and providers operate under their own terms and privacy notices. Review those before supplying information, making a purchase or booking a service.
Unless expressly stated otherwise, we are not the seller or booking agent for an advertised or linked service and do not control that provider’s performance, availability or refunds. This does not exclude responsibility for our own representations or conduct where the law imposes it.
9. Availability and responsibility
We do not promise uninterrupted access or that every article will remain available indefinitely. We may reasonably maintain, update or retire content and features. We aim to avoid unnecessary disruption, particularly where a reader has an existing paid entitlement under separate terms.
To the extent permitted by law, we do not give additional warranties that the free editorial website will meet every reader’s particular requirements or that third-party information will always be current. You should make your own checks for decisions that depend on changing information.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, privacy right or other right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
We do not seek to exclude liability for fraud, wilful misconduct, or any other matter where an exclusion would be unlawful. These terms do not impose a blanket obligation on you to indemnify us for ordinary website use. Any additional liability limitation for a future paid product or service must be presented and assessed in its own terms.
10. Corrections, copyright and complaints
For a correction, rights concern or complaint, contact privacy@humbletrail.com.au or write to The Ordinary Trade Pty Ltd at the address above. Include the relevant page URL, a clear description of the issue, and supporting information you can lawfully provide. For copyright concerns, identify the protected work and the material you believe infringes it, and explain your authority to raise the issue.
We will assess the concern and take appropriate action.
11. Governing law and disputes
These terms are governed by the laws of Victoria, Australia, except where mandatory laws applicable to you require otherwise. Courts in Victoria have non-exclusive jurisdiction. Nothing here prevents you from bringing a claim in another court or contacting a regulator where applicable law gives you that right.
We encourage you to contact us first so we can try to resolve a concern, but doing so is not a condition that removes access to a regulator, urgent relief or a statutory remedy. These terms do not require mandatory arbitration or waive class-action rights.
12. Updates and general provisions
We may update these terms to reflect changes in the website or legal requirements. We will identify the effective date and give reasonable notice of material changes where appropriate. Where renewed agreement is needed for a feature, we will request it. Changes do not retrospectively remove rights that have already arisen.
If a provision is unenforceable, the remaining provisions continue only to the extent they can fairly and lawfully operate without it. A failure to enforce a provision immediately is not a waiver of our right to address a later breach. These terms do not transfer ownership of your personal information to us.
